ON THE APPOINTMENT OF REGIONAL AND MUNICIPAL ADMINISTRATORS

 

 

The Special Representative of the Secretary-General,

 

Pursuant to the authority given to him under United Nations Security Council Resolution 1244 (1999) of 10 June 1999,

 

Taking into account United Nations Interim Administration Mission in Kosovo (UNMIK) Regulation No. 1999/1 of 25 July 1999 on the Authority of the Interim Administration in Kosovo,

 

For the purpose of the efficient administration of Kosovo,

 

Hereby promulgates the following:

 

 

Section 1

REGIONAL ADMINISTRATORS

 

1.1     The Special Representative of the Secretary-General shall appoint, and may transfer or replace, a Regional Administrator for each of the five regions of Kosovo (Pristina, Pec, Mitrovica, Prizren and Gnjilane) to act on his behalf.

 

1.2     The Regional Administrators shall report to the Deputy Special Representative of the Secretary-General for Civil Administration, who shall ensure the implementation of the present regulation.

 

 

Section 2

AUTHORITY AND FUNCTIONS OF REGIONAL ADMINISTRATORS

 

2.1     The Regional Administrators shall control, discharge or otherwise supervise the functions entrusted to public services and local government bodies in the respective regions and may require that those services or bodies seek his or her prior approval for specific decisions or initiatives.

 

2.2     The Regional Administrators may appoint advisory bodies in their respective regions that shall advise the Regional Administrator in the discharge of his or her functions.

 

2.3     The Regional Administrators shall oversee and coordinate the activities of UNMIK staff in their regions.

 

 

Section 3

MUNICIPAL ADMINISTRATORS

 

3.1     The Regional Administrators shall supervise Municipal Administrators for the municipalities in their respective regions.

 

3.2     The Municipal Administrators shall control, discharge or otherwise supervise the functions entrusted to public services and local government bodies in the respective municipalities and Municipal Administrators may require that those services and bodies seek his or her prior approval for specific decisions or initiatives. In particular, the Municipal Administrators shall:

 

(a)    Reactivate or establish and oversee, as the case may be, administrative structures, institutions and enterprises, falling within the jurisdiction of the municipality, to carry out government activities at a municipal level, including revenue generating activities and systems of financial management and control;

 

(b)   Reactivate or establish and oversee modalities for local participation in the decision making process pending elections; and

 

(c)    Coordinate international assistance at the municipal level.

 

 

Section 4

IMPLEMENTATION

 

The Special Representative of the Secretary-General may issue administrative directions in connection with the implementation of the present regulation.

 

 

Section 5

APPLICABLE LAW

 

The provisions of the applicable laws relating to regional and municipal administration shall apply subject to the provisions of the present regulation.

 

 

Section 6

ENTRY INTO FORCE

 

This regulation shall enter into force on 21 October 1999.
