PRISTINA - Two Macedonian nationals, Messrs. Avdil Jakupi and Xhemail Hyseni were today transferred to the custody of the Government of the Former Yugoslav Republic of Macedonia (FYROM) to answer a variety of charges against them, pursuant to Rulings on Transfer signed by the SRSG on 16 April 2004 with regard to each individual.
Mr Hyseni and Mr Jakupi had been in detention in Kosovo since 28 December 2003 and 31 January 2004 respectively. UNMIK Department of Justice received formal requests from the FYROM government for transfer of the two individuals to their custody.
Mr. Hyseni is wanted in FYROM in relation to two convictions for murder and terrorism by FYROM courts. Mr. Jakupi is under investigation by the FYROM authorities for the criminal offences of robbery, kidnapping and participation in a crowd that commits a crime (“criminal participation”), and has been convicted by FYROM courts, with Mr. Hyseni, of the criminal offence of terrorism.
The transfers were carried out after a panel of three judges of the Pristina District Court found that the prerequisites for their transfer had been satisfied under the applicable law and standard assurances, pursuant to the Provisional Criminal Procedure Code of Kosovo, had been obtained from FYROM authorities.
