PRISTINA – Principal Deputy Special Representative of the UN Secretary General in Kosovo (PDSRSG) Larry Rossin today promulgated, on behalf of the SRSG, a Regulation that provides a legislative basis for the allocation of Socially Owned Enterprise (SOE) land assets to municipalities for specified municipal purposes. Currently this land is under the administrative authority of the Kosovo Trust Agency.
PDSRSG Rossin said, “This Regulation will allow municipalities to use socially owned land for public benefit purposes such as for constructing schools, hospitals and cemeteries. This is necessary since there are instances where alternative land is not available to municipalities to accommodate important public needs.”
UNMIK Regulation No. 2006/5 ‘On the Allocation of Land Assets currently under the Administrative Authority of the Kosovo Trust Agency to Municipal Administrations for Public Benefit Purposes’ was signed today in response to concerns that have been raised with UNMIK by the Association of Kosovo Municipalities.
The scope of the Regulation is intentionally narrow, permitting the allocation of this land to municipalities only for certain particular public benefit purposes, subject to criteria and conditions indicated in the Regulation. The provisions of this Regulation take into account, among other things, the interests of the Socially Owned Enterprises and the Kosovo Trust Agency.
The Regulation becomes effective from today. UNMIK looks forward to working with interested municipalities in the effective implementation of the Regulation.
